At Chowbotics (“Chowbotics”, “we”, “us” or “our”), we care about your privacy, and we’re committed to providing transparency about our data protection practices. This Privacy Policy (“Policy”) describes how we collect, use, provide and protect information we collect from our websites (collectively, the “Site”), the Chowbotics’ mobile application (the “App”), and any other website or mobile application that links to this Policy (together, the “Services”), as well as any written, electronic, or oral communications with us or offline information we collect. Each time you use the Services, you signify that you agree to the Terms and Conditions and this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services.

The Services and our business may change from time to time. As a result, at times it may be necessary for Chowbotics to make changes to this Policy. Chowbotics reserves the right to update or modify this Policy at any time and from time to time without prior notice. Please review this Policy periodically, and especially before you provide any personal information to us. This Policy was last updated on the effective date at the top of this Policy. Your use of the Services or your consent to any changes or revisions to this Policy indicate your agreement with the terms of this revised Policy.

  1. Information We Collect or Receive: When you use our Services, we may collect or receive personal information (“Personal Information”) from you, as further described below.
    1. Personal Information That You Provide: We receive Personal Information from you when you directly provide such information to us, such as when you contact us with inquiries, place an order using the Services, or when you request us to email you an electronic receipt using the App. This may include: first and last name, email address; phone number; zip code or city and state that you are located in; usage statistics and purchase patterns; payment information; and any other personal information that you voluntarily provide to us.
    2. Personal Information We May Collect Automatically: When you visit our Site or access the Services, we may automatically receive personal information about you and your device. Such information may include but is not limited to information about your device, referring or exit pages and URLs and number of clicks, the total number of visitors to our Site, the number of visitors to each page of our Site, and IP address. This information allows us to make educated decisions so that we can provide you with better products and Services.
    3. Information from Publicly Available Sources and Third Parties: We may receive information about you from publicly available sources or other third parties. This could include third party social media platforms like Facebook, or our business marketing partners.
    4. Location Information: When you use the Services, we may collect your location information (for example, by using the GPS on your mobile device) in connection with the operations of our business, including to provide and improve certain functionality of our Services. You can choose whether to enable the location tracking feature through the settings on your mobile operating system.
    5. Order data: To efficiently retrieve and dispense the correct order for you, we assign and store a unique Order ID for each order placed using our App and our food robots (“Sally”). We collect the following information from Sally and about each order: price, tax, discount, contents of the food bowl ordered, and feedback about the ordering experience; without any information or details that may identify you. We collect and store aggregated analytics related to our sales, such as “Bowls Per Day” along with hourly, weekly, and monthly trends, and ingredient usage, and any information related to food robot’s health, e.g., temperature logs, uptime, downtime, and error conditions.
  2. Cookies and Other Tracking Technologies: We use cookies, identifiers for mobile devices, and similar technology to collect data, to provide additional functionality to the Services and to help us analyze Services usage more accurately.
    1. What are cookies? Cookies are small data files that are placed on your device when you visit a site or use online services. Cookies are commonly used by businesses to make their websites or services work or function more efficiently, and to provide reporting information. For example, we may set a cookie on your browser that allows you to access our Site without needing to re-enter your password.
    2. Do Not Track Signals: Our Services currently do not respond to “Do Not Track” (DNT) signals and operate as described in this Privacy Policy whether or not a DNT signal is received.
    3. The Services uses Google Analytics and other Google services to improve our content and keep it free. Google Analytics places cookies on your computer, to help the website analyze how users use the Services.   3. How We Use Personal Information
    1. To Communicate with You: We may use your Personal Information to respond to your requests or questions. We may provide you with information about your account or our relationship with you. We may send you emails or text messages, provide push notifications to your device, provide you with online content. Information we provide may include account and order information, newsletters, promotions, marketing and other offers or information which we believe you may find interesting.
    2. To Provide You with the Services: We may use your Personal Information to provide you with the Services. For example, if you direct us to email an electronic receipt of your purchase at our food robot to you, we will use the email address you provide through to email you an electronic receipt. Once we send you the receipt that you have requested from us, your email and receipt are promptly deleted.
    3. To Improve Our Services: We may also use your Personal Information to help us improve the content and functionality of the Services, to better understand our users and consumers, and to improve our products and the Services.
    4. To Comply with Law: We may use your Personal Information to comply with a legal obligation, protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or to defend against potential legal liability.
  4. Provision of Personal Information to Third Parties: There are certain circumstances in which we may provide your Personal Information with certain third parties, as set forth below:
    1. Service Providers (Including Those in Foreign Countries): We may share your Personal Information with our third-party providers for certain business purposes such as to facilitate payment, advertising services, marketing services, and other services. These third-party service providers may be located in the United States or other foreign countries.
    2. Business Transfers: As we develop our business, we might decide to sell or buy businesses or assets. In connection with any potential or actual corporate sale, merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, dissolution or similar event or transaction, Personal Information may be disclosed to third parties as it may be part of the assets potentially transferred or otherwise relevant to the transaction.
    3. Group Companies: We may provide your Personal Information to our group companies for business purposes.
    4. Business Partners: We may share your Personal Information with our business partners. These partners include those in whose products or services we believe you may be interested.
    5. Legal Authorities: We may disclose your Personal Information if subpoenaed or if we are required to do so by law, regulation, legal process, or by any court of competent jurisdiction or any inquiry or investigation by any governmental, official or regulatory body which is lawfully entitled to require any such disclosure.
    6. Reports: In providing the Services, we may use Personal Information to generate certain analysis and reports (“Reports”), where such Reports may indirectly disclose information related to your Personal Information. Such Reports may be shared on certain Social Media Services (as defined below).
    7. Other Disclosures: We may share information for other reasons with your consent or at your direction or that we may describe to you.
  5. Third Party Sites and Tools: The Services may contain third party content or links to third-party websites not operated or controlled by Chowbotics (We do not control these third parties or their use of these technologies and recommend that you read their privacy policies to understand their data practices.
  6. Integrating Social Media Services: Through the Services, you may choose to access certain social media services, such as Facebook and Twitter (“Social Media Services”). When you elect to access and use the Social Media Services through those Third-Party Sites you will be sharing your information (which will include personal information if you or other users elect to share such information) with those Social Media Services. As with other Third-Party Sites, the information that you or others share with the Social Media Services will be governed by the privacy policies, and terms of service of the providers of such Social Media Services and not by Chowbotics’ policies and procedures. You may also have the option of posting your Services activities to Social Media Services when you access content through the Services (for example, you may post to Facebook that you performed an activity on the Services); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Media Services you have enabled will be able to view, comment, and react to such activity.
  7. Data Retention: We keep your information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and/or as required to comply with applicable laws.
  8. Security: The security of your Personal Information is important to us at Chowbotics. We take commercially acceptable steps to protect the Personal Information that you provide to us. Unfortunately, no Internet or email transmission is ever 100% secure or error free, so we cannot fully guarantee the absolute security of any Personal Information. Therefore, you should take special care in deciding what information you send to us via the Services.
  9. California Residents: You have the following rights under the applicable law. Your rights are not absolute and are subject to certain exceptions. For instance, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information, your account with us or the security of our systems. The following is an overview of rights granted to you under the California Consumer Privacy Act of 2018 (“CCPA”). These rights are subject to the limitations set forth in the CCPA.
    1. Right to Know – You have the right to request that we disclose the Personal Information we retain about you.
    2. Right to Delete – You have the right to request that we delete any Personal Information we maintain about you.
    3. Right to Opt-out – You have the right to opt-out from marketing emails from us. To unsubscribe from our emails, please follow the instructions in any email you receive from us. Please note that if you elect to opt-out of marketing related emails, we may still contact you via email to respond to your requests and provide our Services.
    4. Right to Cease Third-Party Provision – You have the right to request that we cease the provision of your Personal Information to third parties in the case that there is a violation of the CCPA.
    5. Right to Non-Discrimination – Chowbotics will not discriminate against those who exercise their privacy rights. Specifically, if you exercise your privacy rights, we will not deny providing you with goods or Services, charge you different prices or rates for goods or Services or provide you a different level or quality of goods or Services.
  10. International Users: The information discussed in this Policy may be collected in or transferred to the United States. If you are located outside the United States and choose to provide information to us, you agree that such information will be processed in the United States for the purposes described herein. As described above, Chowbotics may also subcontract the processing of your data to, or otherwise share your data with, Chowbotics affiliates, service providers, and business partners in the United States or countries other than your country of residence. The data-protection laws in these countries may be different from, and less stringent than, those in your country of residence. You expressly consent to such transfer and processing.
  11. Your Rights: The law in your jurisdiction may give you the right to access, update and correct inaccuracies in your personal information in our custody or control. You may request access, updating and corrections of inaccuracies in your personal information in our custody or control by emailing or writing to us at the contact information set out below. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records.
  12. Children’s Information: Chowbotics does not knowingly collect Personal Information from children under the age of 13. If you are under the age of 13, please do not submit any Personal Information through the Services. We encourage parents and legal guardians to monitor their children’s information and to ensure their children never to provide Personal Information to us. If you have reason to believe that a child under the age of 13 has provided Personal Information to Chowbotics, please contact us as described below.
